Acceptance of These Terms
By downloading, accessing, or using the MudMonster mobile app or website (together, "the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. These terms apply to all visitors, registered users, and MUD operators who submit listings.
Description of the Service
MudMonster is a client for Multi-User Dungeon (MUD) games and a companion community and discovery platform. The app lets you connect to third-party MUD servers and configure your experience with features such as triggers, aliases, timers, variables, character profiles, and terminal preferences. The website provides MUD discovery, listings, reviews, and voting. We do not operate the MUD servers you connect to; those are independently run by third parties.
Eligibility and Age
You must be at least 13 years old to create an account and use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these terms.
Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it current. Notify us promptly if you believe your account has been compromised. We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these terms.
Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent MUD listings.
- Manipulate voting through bots, scripts, or coordinated inauthentic behaviour.
- Post reviews you did not write personally or that misrepresent your experience.
- Harass, threaten, impersonate, or abuse other users.
- Attempt to gain unauthorised access to any part of the Service or its systems.
- Distribute spam, malware, or unsolicited commercial communications.
- Scrape or copy the platform in bulk without prior written permission.
- Use the Service to violate any applicable law or the rights of others.
User Content
"User Content" means any reviews, MUD listings, display names, or other content you submit to the Service. You retain ownership of your User Content. By submitting it, you grant MudMonster a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and distribute that content in connection with operating and promoting the Service.
You are solely responsible for your User Content and represent that you have the rights to submit it and that it is not defamatory, obscene, infringing, or otherwise unlawful. When submitting a MUD listing, you represent that you are authorised to list the server and that the information you provide is accurate.
We may review, moderate, reject, or remove any User Content or listing at our discretion, including content that violates these terms or listings for servers that are offline, abandoned, or unresponsive to administrative requests. We may contact you at the email associated with a listing to verify it or request updates, and listings that do not respond to administrative requests within 30 days may be removed.
Subscriptions and Billing
The Service may offer paid subscriptions ("Mudborn") and one-time contributions ("Helpings"). These are purchased through Apple In-App Purchase and, where recurring, renew automatically unless cancelled. Your Apple ID account is charged at confirmation of purchase and, for auto-renewing subscriptions, at the start of each renewal period unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel a subscription at any time in your App Store account settings. Refunds are handled by Apple in accordance with the App Store's policies; we do not process payments or issue refunds directly. Subscription entitlements are managed through our provider, RevenueCat.
We may change subscription pricing or features on a prospective basis; where required, we will provide notice to active subscribers before changes take effect.
Intellectual Property
The MudMonster name, logo, software, and original content are owned by MudMonster and protected by intellectual property laws. Except for User Content you own, you may not copy, modify, distribute, or create derivative works from the Service without prior written permission. MUD games listed in the directory are the intellectual property of their respective owners.
If you believe content on the Service infringes your copyright, contact us at support@codesquatch.com with a notice that complies with the Digital Millennium Copyright Act (DMCA), and we will respond appropriately.
Third-Party MUDs Disclaimer
MudMonster is a client that lets you connect to independently operated, third-party MUD servers. We do not own, operate, control, or endorse those servers. We are not responsible for their availability, content, rules, moderation, security, or the conduct of their operators or players. Any interaction you have with a third-party MUD server is solely between you and that server's operator, and you connect at your own discretion and risk.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, and we do not endorse or vouch for any MUD server listed in the directory.
Limitation of Liability
To the maximum extent permitted by law, MudMonster and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim shall not exceed the greater of the amount you paid us in the 12 months preceding the claim or USD 100.
Indemnification
You agree to indemnify and hold harmless MudMonster and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these terms or of any law or the rights of a third party.
Termination
We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
Governing Law
These terms are governed by the laws of Georgia, USA, without regard to its conflict-of-law principles. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the United States of America.
Changes to These Terms
We may update these terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notifying registered users. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
